These Terms of Service ("Terms") govern your access to and use of the Split Pay Plugin and the website at splitpayplugin.com (collectively, the "Service"), operated by Brand on Fire LLC, doing business as Gaucho Plugins ("we," "us," or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Overview
Split Pay Plugin is a WordPress plugin that splits WooCommerce payments between multiple Stripe connected accounts, allowing you to transfer percentages or fixed amounts to vendors, partners, and suppliers. We offer a free version distributed through WordPress.org and a premium version ("Pro") sold through our website via the Freemius platform.
2. Account & License
Premium plans require a valid license key activated through Freemius. Each license specifies the number of sites on which it may be used. You are responsible for maintaining the confidentiality of your license key and account credentials.
Licenses are granted on a per-site basis as selected at purchase (single site, 3-site, or 25-site). You may not share, sublicense, or transfer your license key to any third party without our written consent.
3. Payments & Billing
All premium purchases are processed by Freemius, which utilizes Stripe and PayPal as payment processors. By making a purchase, you also agree to the Freemius Terms of Service.
Subscriptions automatically renew at the end of each billing period (annual) unless cancelled prior to the renewal date. Pricing is subject to change with reasonable notice.
4. Refund Policy
We offer a 30-day money-back guarantee on all premium plans. If you are not satisfied, you may request a full refund within 30 days of your initial purchase or most recent renewal. Refund requests should be submitted through the Gaucho Plugins support portal or via Freemius. Please also review the Freemius Refund Policy for additional details.
5. Acceptable Use
You agree not to:
- Reverse engineer, decompile, or disassemble the plugin beyond what is permitted by applicable law.
- Remove or alter any proprietary notices, labels, or marks.
- Use the Service to violate any applicable law or regulation.
- Redistribute, resell, or sublicense the premium plugin or its code.
6. Intellectual Property
The Service, including all code, design, text, graphics, and trademarks, is the property of Brand on Fire LLC (dba Gaucho Plugins) or its licensors. The free version of Split Pay Plugin is distributed under the GNU General Public License v2 (or later) as required by WordPress.org. Premium features and code are proprietary and subject to the license terms specified in the End User License Agreement (EULA).
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRAND ON FIRE LLC (DBA GAUCHO PLUGINS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Third-Party Services
The Service integrates with or relies upon third-party services, including:
- Freemius — license management, checkout, and subscription billing.
- Stripe and PayPal — payment processing (via Freemius).
- Stripe Connect — payment splitting and connected account transfers.
- Google Analytics — website analytics (may be added or modified over time).
Your use of these third-party services is governed by their respective terms and privacy policies. We are not responsible for the practices of third-party providers.
10. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms. Upon termination, your license to use the premium features will be revoked. You may cancel your subscription at any time through the Freemius dashboard.
11. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in California.
